1. Policy Overview

CNG Studios LLC ("CNG Studios," "we," "us," or "our") respects the intellectual property rights of others and expects the same from users of our websites, applications, and services (collectively, the "Services"). In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512), we will respond expeditiously to valid notices of alleged copyright infringement submitted to our designated agent.

This Policy describes how to submit a DMCA takedown notice, how to submit a counter-notice, and our policy for repeat infringers.

Notices sent to any other address or email will not constitute proper notice under the DMCA.

3. Submitting a Takedown Notice

To submit a valid DMCA takedown notice, please provide all of the following information in writing (email is acceptable). Failure to include any of these elements may result in an invalid notice:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works are involved, a representative list);
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material — preferably the exact URL(s);
  4. Information reasonably sufficient to permit us to contact you (address, telephone number, and email address);
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in the notice is accurate, and that you are the copyright owner or authorized to act on the copyright owner's behalf.

4. What Happens After We Receive a Takedown Notice

Upon receipt of a valid DMCA notice, we will:

If you believe that material you posted was removed or access was disabled by mistake or misidentification, you may submit a counter-notice containing the following:

  1. Your physical or electronic signature;
  2. Identification of the material that has been removed or disabled, and the location at which the material appeared before removal;
  3. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number;
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which CNG Studios may be found), and that you will accept service of process from the person who submitted the original notice or an agent of that person.

It is our policy to terminate the accounts of users who are repeat infringers in appropriate circumstances, consistent with Section 512(i) of the DMCA. We may also, in our sole discretion, limit access to the Services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages. Submit notices and counter-notices in good faith.

9. Scope of This Policy

This Policy applies to copyrighted works hosted on or submitted through CNG Studios websites, applications, and services, including but not limited to:

Customer sites served through our white-label or hosting arrangements (for example, sites operated for third-party customers such as Kobushi Dojo Doral, Pure Pristine Cleans, FC Financial) have their own DMCA policies and designated agents where applicable; notices relating to those sites should be directed to the operators of those sites, not to CNG Studios.

11. Changes to This Policy

We may update this DMCA Policy from time to time to reflect changes in our practices or the law. When we do, we will update the "Last updated" date at the top of this page.

English Controls. This DMCA Policy is available in English and Spanish. In the event of any conflict between versions, the English version shall prevail and govern. The DMCA is United States law and is interpreted and enforced in English regardless of the language in which the policy is presented.
